3. Client Obligations
As a client, you agree to:
- Provide accurate, complete, and truthful information
- Respond promptly to requests for information or documentation
- Disclose all relevant facts, including any adverse information
- Pay all fees and charges in accordance with our fee agreement
- Comply with all applicable immigration laws and regulations
- Notify us immediately of any changes to your circumstances
Failure to meet these obligations may affect the outcome of your matter and our ability to represent you effectively.
4. Fees and Payment
4.1 Fee Structure
Our fees are based on the complexity of your matter and will be outlined in your engagement letter. Fees may be charged as:
- Fixed fees for specific services
- Hourly rates for ongoing matters
- Retainer arrangements
4.2 Payment Terms
Payment is due within 7 days of invoice unless otherwise agreed. We accept payment by bank transfer, credit card, or other agreed methods. Late payments may incur interest charges.
4.3 Disbursements
You are responsible for all disbursements (third-party costs) including government application fees, translation costs, skills assessments, and medical examinations. These are charged in addition to our professional fees.
5. No Guarantee of Outcome
While we will use our best professional efforts to achieve a favorable outcome, we cannot guarantee the success of any visa application or immigration matter. The decision to grant or refuse a visa rests solely with the relevant government authority.
Immigration laws and policies are subject to change, and processing times may vary. We are not responsible for delays or decisions made by government authorities.
6. Confidentiality and Legal Professional Privilege
All information you provide to us is subject to legal professional privilege and will be kept strictly confidential, except where:
- Disclosure is required by law
- Disclosure is necessary to provide our services (e.g., to government authorities)
- You provide written consent to disclosure
- Disclosure is necessary to protect our legal rights
7. Limitation of Liability
To the maximum extent permitted by law, Koenig Visas Lawyers shall not be liable for:
- Any indirect, consequential, or special damages
- Loss of income, profits, or business opportunities
- Decisions made by government authorities
- Delays caused by third parties or circumstances beyond our control
Our total liability for any claim arising from our services shall not exceed the fees paid by you for the specific matter in question.
We maintain professional indemnity insurance as required by law.
8. Termination of Services
8.1 Termination by Client
You may terminate our services at any time by providing written notice. You will be responsible for payment of all fees and disbursements incurred up to the date of termination.
8.2 Termination by Us
We may terminate our services if:
- You fail to pay fees or provide requested information
- There is a conflict of interest
- You provide false or misleading information
- Continuing to act would breach our professional obligations
We will provide reasonable notice of termination and assist with the transition to new representation where appropriate.
9. Refund Policy
Refunds are provided at our discretion and depend on the circumstances of each case:
- Before Work Commences: Full refund minus any administrative costs
- After Work Commences: Refund of unused portion of fees for work not yet performed
- Disbursements: Non-refundable once paid to third parties
- Government Fees: Subject to government refund policies (typically non-refundable)
10. Intellectual Property
All content on our website, including text, graphics, logos, and software, is the property of Koenig Visas Lawyers and is protected by Australian and international copyright laws. You may not reproduce, distribute, or use any content without our written permission.
11. Complaints and Disputes
If you have a complaint about our services, please contact us in writing at [email protected]. We will investigate your complaint and respond within 14 days.
If you are not satisfied with our response, you may contact:

- The Legal Services Commissioner
- The Office of the Migration Agents Registration Authority (OMARA)
12. Governing Law and Jurisdiction
These Terms of Service are governed by the laws of New South Wales, Australia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of New South Wales.
13. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
